Excise policy case: Delhi Deputy CM Manish Sisodia moves SC for bail

NEW DELHI, FEB. 28: The Supreme Court, today, will hear Delhi Deputy CM Manish Sisodia’s plea challenging his arrest by CBI in the multi crore scam of the now scrapped Delhi Liquor policy.

Sisodia’s plea was mentioned before the bench of CJI DY Chandrachud by Senior Advocate AM Singhvi.  Although the bench initially expressed reluctance but agreed to list the plea at 3:50 pm today.

“You have your remedies before the HC under section 482 CrPC. Offcourse we have the power. The matter the other day we entertained (Pawan Khera’s plea) was for clubbing of FIRs. We’ll take it up after the mentioning at the end of the board,” said CJI.

Yesterday, CBI Special Judge Rouse Avenue had remanded Sisodia for five days of CBI custody to question Sisodia. The order was passed by Judge MK Nagpal after hearing arguments of CBI & Sisodia’s lawyer.

The court while aceeding to CBIs request had observed that Sisodia had although joined investigation of this case on two earlier occasions but it was alleged he Jay he had failed to provide satisfactory answers to the questions that were put to him during his examination and interrogation conducted. The court further noted that he by this had thus failed for giving a legitimate explanation with regards to the incriminating evidence which had allegedly surfaced against him in the investigation conducted so far.

The court had also observed, “It is true that he cannot be expected to make self incriminating statements, but the interests of justice and of a fair investigation require that he should come up with some legitimate answers to the questions which are being put to him by the IO.”
